1 Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and Code There ("Developer," "we," "us," or "our") governing your use of the LANConsole iOS and iPadOS application ("App") and any related services or documentation.
By downloading, installing, or using the App, you represent that (a) you are at least 13 years of age, (b) you have the legal capacity to enter into a binding agreement, and (c) you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
Your use of the App is also subject to Apple's App Store Terms and Conditions and, where applicable, Apple's standard End-User License Agreement (EULA) for third-party iOS applications available at apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between Apple's EULA and these Terms, these Terms shall govern with respect to matters specific to LANConsole, and Apple's EULA shall govern with respect to matters within Apple's scope.
2 License
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on any Apple-branded iOS or iPadOS device that you own or control, solely for your personal, non-commercial use and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
This license does not include the right to:
- Reproduce, distribute, or publicly display the App or any portion thereof;
- Modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works based on the App;
- Remove, obscure, or alter any proprietary notices, labels, or marks in or on the App;
- Rent, lease, lend, sell, transfer, sublicense, or otherwise make the App available to any third party;
- Use the App in any manner that violates applicable law or these Terms.
All rights in the App not expressly granted in these Terms are reserved by the Developer. The App is licensed, not sold, to you. The one-time purchase price entitles you to install and use the App on your personal devices subject to this license; it does not transfer ownership of the software, source code, or intellectual property.
3 Permitted Use
LANConsole is a remote administration tool that allows you to establish VNC (Virtual Network Computing) and SSH (Secure Shell) connections to Mac computers over a local area network or other network infrastructure you control.
The App is permitted for use only in the following circumstances:
- Remote control of devices you own: Connecting to Mac computers that you personally own and have configured to accept VNC or SSH connections.
- Remote control of devices you are expressly authorized to access: Connecting to Mac computers owned by an employer, organization, or other individual who has granted you explicit, documented, written authorization to remotely access that specific machine using remote-control software.
- Lawful purposes only: All use must comply with applicable local, state, national, and international laws and regulations, including but not limited to laws governing computer access, data privacy, and electronic communications.
You are solely responsible for obtaining any necessary authorizations before using the App to access any computer, network, or system, and for ensuring your use complies with all applicable laws in your jurisdiction.
4 Prohibited Use
You expressly agree that you will NOT use the App to:
- Access any computer without authorization — whether by using stolen credentials, exploiting misconfigured services, bypassing access controls, or any other means — in violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the Electronic Communications Privacy Act, or any equivalent law in your jurisdiction;
- Exceed your authorized access on any computer system, even one you are authorized to access in a limited capacity;
- Intercept or monitor communications, data, files, or activity on any computer system without the lawful consent of the system owner and all users whose data may be accessed;
- Access, exfiltrate, copy, modify, or delete data, files, or records on any computer you do not own or are not authorized to administer;
- Install malware, spyware, ransomware, or any unauthorized software on any computer system using the App's SSH terminal or other functionality;
- Use the App as part of any hacking, penetration testing, or security research activity on systems you do not own or for which you do not have explicit, written, and legally valid authorization;
- Use the App in connection with any criminal activity, including unauthorized access to government, financial, healthcare, or other regulated systems;
- Circumvent any technical protection measures in the App or use the App to circumvent technical protection measures on any computer or network.
Violation of these prohibitions may expose you to civil liability and criminal prosecution under the Computer Fraud and Abuse Act (penalties up to 10 years imprisonment for first-time offenders under 18 U.S.C. § 1030(c)), state computer crime statutes, and equivalent laws in your country. The Developer will cooperate fully with law enforcement investigations of any suspected unauthorized access facilitated by the App.
5 No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
The App connects to Mac computers, network infrastructure, and services that the Developer does not own or control. The Developer makes no warranty as to the availability, reliability, performance, or security of your Mac computers, your local area network, your router, your internet service provider, Apple's iCloud infrastructure, or any other third-party system or service. Any downtime, data loss, security breach, or connection failure attributable to hardware, operating systems, network equipment, or services outside the App itself is entirely outside the Developer's warranty obligations.
You acknowledge that the App's functionality depends on your Mac having Screen Sharing (VNC) or Remote Login (SSH) enabled with appropriate credentials configured, and that the Developer has no ability to guarantee the availability of services running on hardware you own and operate.
6 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP ON THE APPLE APP STORE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, so the above exclusions and limitations may not apply to you in full. In such jurisdictions, the Developer's liability is limited to the greatest extent permitted by applicable law.
7 Indemnification
You agree to indemnify, defend, and hold harmless the Developer, Code There, and any successors or assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the App in violation of these Terms;
- Your use of the App to access any computer or system without authorization or in violation of applicable law;
- Your violation of any third party's rights, including intellectual property rights, privacy rights, or computer access rights;
- Any data, content, or commands you transmit using the App;
- Your breach of any representation, warranty, or obligation under these Terms.
The Developer reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with the Developer's defense of any such claim. You will not settle any such claim without the Developer's prior written consent.
8 Changes to These Terms
The Developer reserves the right to modify these Terms at any time. When changes are made, the Developer will update the "Last updated" date at the top of this page. For material changes, the Developer will provide notice through the App Store update notes or a notice within the App at the time of the update.
Your continued use of the App after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and may delete it from your device.
Changes to these Terms will not apply retroactively. For disputes arising before the effective date of any update, the Terms that were in effect at the time of the relevant conduct will govern.
9 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to conflict-of-law principles that would require the application of the laws of any other jurisdiction.
Any dispute arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts located in the Developer's jurisdiction of residence. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in such courts.
Notwithstanding the foregoing, the Developer reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or other proprietary rights.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
